1. Who we are

These Terms & Conditions ("Terms") govern your use of the Elegy Flow service ("Service"), provided by Elegy Flow LLC ("Elegy Flow", "we", "us", "our"). By creating an account or using the Service, you are entering into an agreement with Elegy Flow LLC.

2. Acceptance

By accessing or continuing to use the Service, you agree to these Terms. If you do not agree, you may not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. The Service

Elegy Flow provides software that helps funeral homes and related professionals draft compassionate written documents (such as obituaries, eulogies, and condolence communications) using generative AI. We grant you a limited, non-exclusive, non-transferable right to use the Service within the plan you have selected.

4. Acceptable use

You must not misuse the Service. In particular, you may not:

  • use the Service for any unlawful, fraudulent, or deceptive purpose;
  • send spam or otherwise misuse communications generated through the Service;
  • infringe the intellectual property, privacy, or other rights of any person;
  • upload malware, attempt to probe, scan, or breach the security of the Service, or scrape the Service;
  • reverse engineer, resell, or redistribute the Service or circumvent its technical limits.

5. Generative AI use

The Service uses generative AI to produce written drafts. You agree that:

  • you will not use the Service to generate illegal content, deepfakes, hate speech, harassment, malware, or to attempt to jailbreak underlying models;
  • you are responsible for the prompts and information you provide, for verifying the accuracy of any output, and for how you use that output;
  • you must have the necessary rights and consents for any personal information about a deceased person or family that you submit;
  • outputs may be inaccurate or incomplete and are not a substitute for regulated professional advice (legal, medical, financial, or otherwise);
  • we may moderate, filter, restrict, or refuse outputs, and may suspend accounts, to protect the integrity of the Service and the rights of third parties.

If you believe content generated through the Service infringes your rights, contact us and we will review and act on legitimate takedown requests. Repeated infringement may result in termination.

6. Intellectual property

Elegy Flow LLC retains all right, title, and interest in and to the Service, including its software, documentation, and branding. You retain rights to the inputs you submit and the outputs you generate, subject to the rights of underlying model providers and applicable law. You grant us a limited license to host and process your content solely to provide and improve the Service.

7. Payment, subscription, and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, cancellation, and refund mechanics are governed by Paddle's Checkout Buyer Terms. See our Refund Policy for our refund window.

8. Service availability

We work hard to keep the Service running, but we do not guarantee that it will be uninterrupted, error-free, or always available. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Suspension and termination

We may suspend or terminate your access to the Service for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends and we may delete account data after a reasonable export window.

10. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the Service is capped at the fees you paid to Paddle for the Service in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Governing law

These Terms are governed by the laws of the United States and the state in which Elegy Flow LLC is registered, without regard to conflict-of-laws rules. Disputes will be resolved in the competent courts of that jurisdiction, except where applicable law requires otherwise.

12. Changes

We may update these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.
